Terms of Service

1. Who we are and what these terms cover

Scenara (“Scenara”, “we”, “us”) provides an online service at scenara.xyz that generates video, music, and voice audio from text prompts using third-party artificial intelligence models (the “Service”). These Terms of Service (“Terms”) form a binding agreement between you and Scenara. By creating an account, purchasing credits, or using the Service — including via our API or MCP connector — you agree to these Terms. If you do not agree, do not use the Service.

You must be at least 18 years old, or the age of majority where you live, to use the Service.

2. Your account

You are responsible for your account, for keeping your sign-in method and API keys secure, and for all activity that occurs under them. Activity performed with your API key is treated as performed by you. Notify us immediately at contact@scenara.xyz if you believe your account or key has been compromised.

You may not share, sell, or transfer your account, use another person's account without permission, or create accounts by automated means.

3. Credits, payments and refunds

The Service operates on prepaid credits. Credit prices, and the number of credits each generation consumes, are shown before purchase and before each generation. Credits do not expire, are not transferable, have no cash value, and can only be used within the Service.

Payments are processed by Stripe; we never store your card details. Prices include VAT where applicable.

If a generation fails, the credits it consumed are automatically returned to your balance. Credits consumed by successful generations are not refundable — each generation incurs real third-party compute cost the moment it runs.

Unused credits: if you have used none of the credits from a purchase, you may request a refund of that purchase within 14 days at contact@scenara.xyz. Once any credit from a purchase is used, you agree that we begin supplying the digital service immediately and the purchase becomes non-refundable, to the extent permitted by law. Nothing in these Terms affects your statutory rights.

4. Acceptable use

You agree not to use the Service to create, request, or distribute content that: is illegal in your jurisdiction or ours; sexualises, exploits, or endangers minors in any way; depicts real, identifiable people without their consent — including intimate imagery, or content presenting fabricated events as real (“deepfakes”); impersonates any person or organisation in a misleading way; constitutes harassment, hate, or incitement of violence against any person or group; infringes any third party's intellectual property, privacy, or publicity rights; or is designed to deceive, defraud, or spread disinformation, including deceptive political content.

You also agree not to: attempt to circumvent billing, rate limits, or safety systems; probe, disrupt, or reverse-engineer the Service; resell raw access to the Service without our written agreement; or use the Service to build a dataset for training competing models.

We may refuse, filter, or remove content and may suspend or terminate accounts that breach this section. Underlying model providers also apply their own content safeguards; a generation blocked by a provider's safety system is treated as a failed generation and refunded in credits.

5. Your content and ownership

Your inputs: you keep all rights in the prompts, lyrics, scripts, and other material you submit (“Inputs”). You grant us a licence to process Inputs solely to operate the Service — including transmitting them to the third-party model providers who perform the generation.

Your outputs: as between you and Scenara, you own the videos, music, and audio the Service generates for you (“Outputs”), including for commercial use, to the fullest extent permitted by the licences of the underlying model providers and applicable law. You are responsible for ensuring your use of Outputs complies with law — note that purely AI-generated works may have limited copyright protection in some jurisdictions.

We do not use your Inputs or Outputs to train AI models. We store Outputs in your library so you can access them; you can delete them at any time, and we may permanently remove content you delete.

6. Third-party models

Generations are performed by third-party AI models (including models from providers such as Kling, Alibaba (Wan), Google (Veo), MiniMax, and ElevenLabs) accessed through infrastructure partners. Model availability, behaviour, and quality may change or be withdrawn without notice; where a model is withdrawn we will substitute a reasonable alternative where possible. AI outputs are probabilistic: we do not guarantee any particular result, accuracy, or suitability of generated content.

7. Intellectual property complaints

We respect intellectual property rights. If you believe content generated or hosted through the Service infringes your rights, email contact@scenara.xyz with: identification of the work, the URL of the allegedly infringing content, your contact details, and a statement of good-faith belief. We will review and, where appropriate, remove content and act against repeat infringers.

8. Availability and changes to the Service

We aim for high availability but the Service is provided “as is” and “as available”. We may modify, suspend, or discontinue features (including models and pricing) at any time. Material changes that reduce the value of credits you have already purchased will not apply retroactively to those credits.

9. Disclaimers

To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that Outputs will be free of artefacts, accurate, or suitable for any purpose.

10. Limitation of liability

Nothing in these Terms excludes liability that cannot be excluded by law, including for death or personal injury caused by negligence, or for fraud. Subject to that, we are not liable for indirect or consequential loss, loss of profit, revenue, data, or goodwill; and our total aggregate liability arising out of or relating to the Service is limited to the greater of £100 or the amounts you paid us in the 12 months before the event giving rise to the claim.

11. Indemnity

You will indemnify and hold us harmless from claims, damages, and reasonable costs (including legal fees) arising from your Inputs, your use of Outputs, or your breach of these Terms — including claims that content you created or published using the Service infringes a third party's rights.

12. Suspension and termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access immediately if you materially breach these Terms (including Section 4), if required by law, or to protect the Service or other users. If we terminate without cause, we will refund the value of your unused credits. If we terminate for your breach, unused credits are forfeited to the extent permitted by law.

13. Changes to these Terms

We may update these Terms from time to time. For material changes we will give notice (for example by email or in-product notice) at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.

14. Governing law

These Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, except where the law of your country of residence grants you mandatory consumer protections and jurisdiction.
